Welcome to Bagels & More. This page, including the documents referred to it, contains the terms and conditions under which you may use our website and services offered by us, via phone or our website (bagelsandmore.co.uk).

We believe that we have kept information on our site clear and easy to understand, but in case of any doubt, please read these terms and conditions carefully before ordering as these terms will apply to any orders you place. By accessing our site and placing an order you approve that you have read, understood and agree to be bound by these terms and conditions and our terms of use policy. If you do not accept these terms and conditions, you should not place an order.

Service availability

​

The purpose of our site is to provide a simple and convenient service to our Bagels & More customers to order food online or via phone. Our interactive menus allow you to build and submit your orders in a clear, informative and easy-to-use format. 

For the safety of our drivers, unless specific arrangements have been agreed upon with the store in advance, a driver will only deliver to the main door/reception when delivering to apartment blocks, flats or hotels.

Subject to minimum delivery spends, Bagels & More offers a delivery service to certain prescribed areas of Rugby, Warwickshire to ensure that our products are at their best when they reach your door. If you live outside a prescribed delivery area, you may have products delivered to your door at an additional delivery fee.

For their safety and security, when delivering to apartment blocks, flats or hotels, drivers may deliver straight to customers’ doors, or they may deliver to the main door/reception area of the building and they will carry less than £10 in cash.

Your status
 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited or under any law or regulation applicable to you.

If you place an order via our site or via phone you will be presented with confirmation on your screen that your order has been received and accepted by Bagels & More. Your contract with Bagels & More is only formed when you have been presented with this confirmation. 

You will also receive a confirmation email. Please make sure that the email address, home address and telephone number you provide are correct and in proper working order, as these are required to fulfil your order. Please note that incorrect personal details may lead to problems with your order or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when registering your details. 

Please understand that the 'Order Confirmation' emails are generated electronically - please do not reply to these emails as they cannot be read or acted upon. If you have any urgent queries resulting from the 'Order Confirmation' email, please telephone Bagels & More to advise and agree to any changes that may be required.

All food preparation and deliveries are the sole responsibility of Bagels & More.

Problem with your order?

We work hard to maintain a commitment to high standards of menu quality and customer service but we know that sometimes mistakes can happen and we do want to make things right for you.

In the unlikely event that you are not happy with your order, it is very important that you contact Bagels & More immediately. In almost all cases Bagels & More will be able to resolve your concerns straight away.  You can also use the 'feedback or complaint's link on our website and but please be aware that Messages sent using this 'feedback or complaints' link will only be read during opening hours. In the event that the store is closed by the time you are able to call about any issues, please ensure that you take photo evidence of any menu items that you are dissatisfied with until you can contact Bagels & More so they can arrange a solution. If you do not take evidence of the menu item that you have a problem with, thereby denying our team the opportunity to investigate what has gone wrong, then you will forfeit any right to refund or replacement. (Subject always to your statutory rights.) This is very important so that we can ensure that any complaints can be thoroughly investigated and reviewed to determine whether any updates or changes to operating procedures are judged to be necessary.

Cancellation

​

In order to maintain our target for an efficient and timely delivery service we work very quickly to commence the preparation of your order so it can be very costly to cancel an order once we have confirmed receipt of your order and sent a confirmation email. If you have an urgent need to cancel your order please telephone Bagels & More urgently to check the situation. Please understand that the 'Order Confirmation' emails are generated electronically - please do not reply to these emails/push* messages as they cannot be read.  Please be aware that it may not be possible to cancel the order once we have started to make the menu items you have ordered. Bagels & More will have the final decision on whether an order can be cancelled depending on how far the making process has progressed. If the order cannot be cancelled the charge will be confirmed and no refund will be due.

An order may be cancelled by  Bagels & More, Bagels & More reserves the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.

You will not be charged for cancelled orders made in accordance with these cancellation provisions. Any payment made prior to an order being cancelled Bagels & More will usually be reimbursed using the same method originally used by you to pay for your purchase.


 

Availability and Delivery

We strive to maintain on-time delivery. However, unfortunately, things do not always go to plan and factors outside of our control such as the weather and traffic conditions may occasionally prevent us from achieving this.

Bagels & More will do their best to fulfil your order by the dynamic delivery times displayed to you. However, these timings are estimates only and Bagels & More does not guarantee the accuracy of the dynamic delivery timer. This means that you won’t be entitled to cancel your order or claim compensation if your order isn’t fulfilled by the dynamic delivery time displayed. Should you be unsatisfied with your order you can follow the standard process available to all customers and contact us via our Contact Form.

Delivery isn't easy - but we are determined to get it right. That's why we don't support the use of third-party delivery service companies to deliver our food. We like to deliver our bagels ourselves as it allows us to maintain high standards and ensure that you are delivered a piping hot pizza.

Bagels & More will do its best to fulfil your order in accordance with the date and time confirmed to you at the time of your order. Delivery charges may apply.


 

Products


All products are subject to availability. In most cases, Bagels & More will offer an alternative for any out-of-stock item. 

We do use nuts in our products, and some ingredients are produced in factories that handle nuts and other allergens. For allergen information see here.

Bagels & More is a busy working environment and there is a risk of cross-contamination between fillings. If you have an allergy we kindly ask that you do not order food. Unfortunately, for the time being, we are not able to accept orders from customers with allergies.

We do have a number of options available for vegetarians which are indicated on our menus. We also have procedures in place for making bagels that are suitable for vegetarians however please note that we do not have a dedicated preparation or cooking area in our stores for vegetarian food. If you are a vegetarian please inform Bagels & More who will do their best to ensure that any risk of cross-contamination with your order is minimised.

Great care is taken in the preparation of all our products, however, we cannot guarantee that all bones from meat products have been removed and some may remain. Our bagels are handmade daily. The images of our products contained on our menus and Sites are for illustrative purposes only. Although we try our hardest to be consistent, at times, the size of the bagels can vary and the products you order may vary slightly from those images.


 

Retention of the right to change offers

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Bagels & More. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.


 


Price and payment

The price of all menu items will be as quoted on our website and may vary from time to time, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation email.

Despite our best efforts, some of the Menu Items listed on our site may be incorrectly priced. Bagels & More will normally verify prices as part of the order process.

Payment for all Menu items can be by credit or debit card at the point of ordering or in cash at the point of collection or delivery. Under normal circumstances, any refund authorised by the Bagels & More will be made during opening hours on the next Business Banking Day - Monday to Friday. Any Refunds authorised will be made using the same method originally used by you to pay for your order.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.


 

Our liability

To the extent permitted by law, Bagels & More provides makes no representation or warranty of any kind, express or implied, regarding the content or availability of our site, or that it will be timely or error-free, that defects will be corrected, or that our site or server that makes it available are free of viruses or other harmful components.

Subject to the previous paragraph, Bagels & More shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use our site.

The liability of Bagels & More for losses you suffer as a result of a Bagels & More breaking the contract, including deliberate breaches, is strictly limited to the purchase price of the Menu Item(s) you order.

This does not include or limit in any way our or our agents or employees' liability:

  1. for death or personal injury caused by negligence;

  2. for fraud or fraudulent misrepresentation; or

  3. for any matter for which it would be illegal for us to exclude, or attempt to exclude our liability.


 

Written communication

Applicable laws require that some of the information or communications we send to you should be in writing. When using our Sites, you agree that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. You agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Events outside our control

Bagels & More will not be liable or responsible for any failure to perform or delay in the performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a "Force Majeure Event").

 

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond both our reasonable control and the reasonable control of tBagels & More and includes (without limitation) the following:

  1. strikes, lock-outs or other industrial action;

  2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

  3. fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters;

  4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

  5. impossibility of the use of public or private telecommunications networks; or

  6. the acts, decrees, legislation, regulations or restrictions of any government.

Promotional emails and content

 

You agree to receive from time to time promotional messages and materials from us, by email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
 

Waiver

If Bagels & More shall fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions, or if Bagels & More fails to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by Bagels & Moree of any default shall not constitute a waiver of any subsequent default.

No waiver by Bagels & More of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing (email correspondence will be permitted).

Severability

Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.


ENTIRE AGREEMENT

These terms and conditions and any document expressly referred to in them represent the entire agreement in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement with Bagels & More, whether spoken or in writing. 

 

Our rights to vary these terms and conditions

Bagels & More has the right to revise and amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the policies and terms and conditions in force at the time that you order any Menu Item(s) from Bagels & More, unless any change to those policies or these terms and conditions is required to be made by law, regulatory or enforcement authority

 

Law and jurisdiction

Contracts for the purchase of Menu Items through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
